The Federal Emergency Management Agency (FEMA) hereby gives notice to the public of its intent to reimburse eligible applicants for eligible costs to repair or replace facilities within their authority and jurisdiction which were damaged as a result of:
California Severe Winter Storms, Flooding, Landslides, and Mudslides, incident period of December 27, 2022 – January 31, 2023, under the major disaster declaration FEMA-4683-DR-CA, signed by the President on January 14th, 2023;
California Severe Winter Storms, Straight-line Winds, Flooding, Landslides, and Mudslides, incident period of February 21, 2023 – July 10, 2023, under the major disaster declaration FEMA-4699-DR-CA, signed by the President on April 3rd, 2023;
California Tropical Storm Hilary, incident period of August 19, 2023 – August 21, 2023, under the major disaster declaration FEMA-4750-DR-CA, signed by the President on November 21st, 2023;
and California Severe Winter Storms, Tornadoes, Flooding, Landslides, and Mudslides, incident period of Jan 31, 2024 – Feb 9, 2024, under the major disaster declaration FEMA-4769-DR-CA, signed by the President on April 13th, 2024.
Initial disaster-wide Public Notices were published on September 11, 2023, for DR-4683 California Severe Winter Storms, Flooding, Landslides, and Mudslides; on November 1, 2023, for DR-4699 California Severe Winter Storms, Straight-line Winds, Flooding, Landslides, and Mudslides; on December 27, 2023, for DR-4750 California Tropical Storm Hilary; and on April 13, 2024, for DR-4769 California Severe Winter Storms, Tornadoes, Flooding, Landslides, and Mudslides.
Under the National Environmental Policy Act (NEPA), federal actions must be
reviewed and evaluated for feasible alternatives. Additionally, Executive Order (EO) 11988 and EO 11990 require all federal actions in or affecting the floodplain or wetlands be reviewed for opportunities to relocate and evaluated for social, economic, historic, environmental, legal, and safety considerations. Where there is no opportunity to relocate, FEMA is required to undertake a detailed review to determine what measures may be taken to minimize future damages, to consider alternatives, and provide a public notice of any proposed actions in or affecting floodplains or wetlands. EO 12898 promotes nondiscrimination in federal programs that affect human health and the environment and requires FEMA to provide the opportunity for public participation in the planning process and to consider potential impacts to minority and low-income populations.This notice may also fulfill requirements under Section 106 of the National Historic Preservation Act (NHPA). The NHPA requires federal agencies to take into account the effect of their undertakings on historic properties. Those actions or activities affecting buildings, structures, districts or objects 50 years or older or that affect archeological sites or undisturbed ground will require further review to determine if the property is eligible for listing on the National Register of Historic Places (Register). If the property is determined to be eligible for the Register and FEMA’s undertaking will adversely affect it, FEMA will provide additional public notices. For historic properties not adversely affected by FEMA’s undertaking, this will be the only public notice.
The Rehabilitation Act of 1973 protects the civil rights of persons with disabilities. It prohibits discrimination on the basis of disability by the federal government, federal contractors, and by recipients of federal financial assistance. Any recipient or sub-recipient of federal funds is required to make their programs accessible to individuals with disabilities. Its protections apply to all programs and businesses that receive any federal funds. This applies to all elements of physical/architectural, programmatic and communication accessibility in all services and activities conducted by or funded by FEMA. FEMA intends to comply with the Rehabilitation Act in all federally conducted and assisted programs in alignment with the principals of whole community inclusion and universal accessibility.
This notice serves as a cumulative final notice for FEMA’s funding action located within the floodplain and wetlands. This notice applies to the Public Assistance (PA) program implemented under the authority of the Robert T. Stafford Disaster Relief and Emergency Assistance Act, 42 U.S.C. §§ 5121-5207. This notice is to inform the public of FEMA’s intent to allocate grant funds to State, local, and tribal governments, as well as non-profit organizations for the repair or replacement of facilities within designated areas susceptible to flooding. These flood zones include A & AE-Zones, which are areas susceptible to a 1% annual chance of flooding up to the Base Flood Elevation (BFE). Shaded X-Zones, which are areas susceptible to 0.2% annual chance of flooding, are considered with respect to critical actions (actions for which even the slightest chance of flooding is too great). This does not cover actions that are located in the floodway or coastal high hazard area. In all cases, FEMA has followed the 8-step process laid out in 44 CFR Part 9 to determine the overall effect of projects within these areas and this notice shall only pertain to those projects which were determined to be practicable.
For Special Flood Hazard Areas (A & AE-Zones), this notice represents those projects that require the full 8-step process as set forth in 44 C.F.R. Part 9 and in which the function is not otherwise served by a more practicable alternative. For these types of projects, relocation or abandonment of the facilities would cause adverse social and economic impacts to the local community. Flood risk will be minimized by all practicable means and projects will not adversely affect the floodplain or wetlands.
This notice does not apply to projects that:
(A) are bridge projects over $100,000 (each individual site); or
(B) cost more than 50% to restore the facility [44 CFR Part 9.5(d)(2) and (d)(4)]; or
(C) are in the floodway or coastal high hazard areas; or
(D) are construction of temporary access road(s); or
(E) are projects that require a Hydraulic and Hydrologic (H&H) study; or
(F) projects that include mitigation measures; except for upgrades for current codes and standards and/or least cost alternatives.
The project sites may be located in floodplains as mapped by the following NFIP participating communities:

For such projects described above, this cumulative final public notice hereby fulfills the requirements of Executive Orders 11988 and 11990 consistent with 44 CFR § 9.12. Pursuant to Executive Order 11988 and 44 C.F.R. § 9.12, final notice is hereby given of FEMA’s intent to provide funding for these projects under the Public Assistance (PA) Program.
Funding for the proposed projects will be conditional upon compliance with all applicable EOs, federal, tribal, state and local laws, regulations, floodplain standards, permit requirements and conditions. This action complies with the National Flood Insurance Program (NFIP) requirements.
For those projects where the above criteria are not met, a project-specific final public notice will be published, allowing public comment with final agency action taken after 15 days, as prescribed in 44 C.F.R. § 9.12(f).
This will serve as the final public notice regarding the above-described actions funded by the FEMA PA program for all three declared events. Interested persons may submit comments, questions, or request a map of a specific project by writing to the Federal Emergency Management Agency, Region 9, 1111 Broadway, Suite 1200, Oakland, CA 94607-4052 or by emailing FEMA-R9EHP@fema.dhs.gov. Comments should be sent in writing with the subject line CA – 4683-4699-4750-4769 – Cumulative Final Public Notice at the above address within 15 days of the date of this notice.
