K. Remedies for Non-Compliance

If a recipient fails to comply with federal statutes, regulations or terms and conditions of a federal award—whether they are stated in an assurance, a HMGP Administrative Plan or application, a notice of award, the guidance or elsewhere—FEMA may take one or more of the following actions, as appropriate:

  • Temporarily withhold cash payments pending correction of the deficiency by the recipient.
  • Disallow (that is, deny both use of assistance and any applicable matching credit for) all or part of the costs of the activity or action not in compliance.
  • Wholly or partly suspend or terminate the federal award.
  • Initiate suspension or debarment proceedings.
  • Withhold further federal awards for the activity.
  • Take other remedies that may be legally available.[231]
  • Terminate the federal award if a recipient fails to comply with the terms and conditions of a federal award.[232]

These remedies may be applied to non-compliance findings from the Government Accountability Office and Department of Homeland Security Office of the Inspector General audits. For single audits, FEMA will first use the notification procedures in Part 9; however, if compliance is not achieved through implementing corrective actions, the remedies outlined in Part 8.K.1 will be used.
