A Lei Robert T. Stafford de Alívio a Desastres e Assistência à Emergência declara em parte que: "Todos os pedidos de uma declaração do presidente de que existe um grande desastre devem ser feitos pelo governador do estado ou território afetado ou pelo líder tribal".
